Recently, the Supreme Court of India passed a Suo moto order directing the removal of all stray dogs in Delhi-NCR within just 8 weeks.

The dogs are to be “picked up” and kept in shelters. On paper, this may look like a solution to stray dog issues.

In reality, it is illegal, impractical, and deeply inhumane. Worse, it sets a dangerous precedent that could affect every city in India.

 

Why This Order is Problematic

  1. It Violates Existing Laws

India already has the Animal Birth Control (ABC) Rules, 2023. These rules clearly state that stray dogs cannot be randomly relocated or confined.

The only legal and effective method is sterilization and vaccination — followed by release back into their original territory.

This judgment directly contradicts the laws that our courts themselves helped frame.

 

  1. It’ Logistically Impossible

Delhi-NCR has lakhs of stray dogs.

  • Where will they all be kept?
  • Do we have enough shelters?
  • Enough food, staff, and medical care?

The truth: We don’t. Confinement will only lead to overcrowding, disease outbreaks, and unimaginable cruelty.

 

  1. It Wastes Funds Already Allocated

Government bodies already receive funds for sterilization and vaccination programs. If those funds were used effectively, we wouldn’t be in this situation.
The real question is: Why aren’t these programs working on the ground? Instead of fixing corruption and inefficiency, the decision jumps straight to mass confinement.

 

  1.  It Ignores Real Urban Problems

Delhi is battling pollution, crime, garbage mismanagement, waterlogging, unsafe roads, and rising violence against women.
Yet, instead of addressing these urgent crises, the focus has shifted to scapegoating stray dogs.

 

Why We Must Resist This Order

If this decision goes through, Delhi’s dogs will suffer — but so will our democracy. When courts ignore existing laws and push impractical solutions, it weakens trust in justice itself.

And if it can happen in Delhi, it can happen anywhere in India.
